Resolution 2140 (2014)

On 26 September 2022, the Security Council Committee established pursuant to resolution 2140 (2014) approved the addition of two entries specified in the link above to its Sanctions List of individuals and entities subject to the measures imposed by the Security Council and adopted under Chapter VII of the Charter of the United Nations.

Please be reminded that all EU/UN sanctions are directly applicable under Maltese law under the National Interest (Enabling Powers) Act, cap 365 of the Laws of Malta as linked here.

Should any of your clients be a person or entity who is listed under UN/EU or national sanctions or who is directly or indirectly owned or controlled by a listed person or entity, the freezing measures mentioned under article 17 of the Act apply.

The Sanctions Monitoring Board is to be informed immediately of the actions that have been taken in relation to the assets of such listed persons.

Central African Republic Regime

Council Regulation (EU) 2022/1621 of 20 September 2022 amending Regulation (EU) No 224/2014 concerning restrictive measures in view of the situation in the Central African Republic

The Council of the European Union on 20 September 2022 decided to adopt Council Decision (CFSP) 2022/1626, which amends Decision 2013/798/CFSP in accordance with UNSC Resolution 2648 (2022). In this regard, Regulation (EU) No 224/2014 has been amended accordingly by way of an amendment to Article 3.

Council Decision (CFSP) 2022/1626 of 20 September 2022 amending Decision 2013/798/CFSP concerning restrictive measures against the Central African Republic

The Council of the European Union on 20 September 2022 decided to amend Decision 2013/798/CFSP in accordance with UNSC Resolution 2648 (2022) by way of an amendment done to the title as well as to Article 2.

Please be reminded that all EU/UN sanctions are directly applicable under Maltese law under the National Interest (Enabling Powers) Act, cap 365 of the Laws of Malta as linked here.

Should any of your clients be a person or entity who is listed under UN/EU or national sanctions or who is directly or indirectly owned or controlled by a listed person or entity, the freezing measures mentioned under article 17 of the Act apply.

Ukraine Regime

· Council Implementing Regulation (EU) 2022/1501 of 9 September 2022 implementing Regulation (EU) No 208/2014 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Ukraine

On 09 September 2022, The Council of the European Union decided to amend Annex I to Regulation (EU) No 208/2014 and deleted the following entries from Annex A and B:

1.	Viktor Fedorovych Yanukovych;

3.	Viktor Pavlovych Pshonka;

7.	Oleksandr Viktorovych Yanukovych;

9.	Artem Viktorovych Pshonka;

· Council Decision (CFSP) 2022/1507 of 9 September 2022 amending Decision 2014/119/CFSP concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Ukraine

On 9 September, the Council of The European Union amended Decision 2014/119/CFSP. The restrictive measures have been extended up until 06 March 2023.

On 09 September 2022, the Council of the European Union amended Annex XIII to Regulation (EU) 2017/1509 and Annex I to Decision (CFSP) 2016/849 accordingly.

Iraq Regime

Commission Implementing Regulation (EU) 2022/1464 of 2 September 2022 amending Council Regulation (EC) No 1210/2003 concerning certain specific restrictions on economic and financial relations with Iraq

The European Commission on 02 September 2022 decided to amend Annex IV to Regulation (EC) No 1210/2003 by deleting an entry from the list of natural and legal persons, bodies or entities associated with the regime of former President Saddam Hussein covered by the freezing of funds and economic resources and by a prohibition to make funds or economic resources available.

The Council of the European Union on 01 September 2022 decided to amend Annex I to Regulation (EU) No 269/2014 by adding three persons to the list of natural and legal persons, entities and bodies subject to restrictive measures set out in the aforementioned Annex.

· Council Decision (CFSP) 2022/1447 of 1 September 2022 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine

The Council of the European Union on 04 August 2022 decided to Annex I to Regulation (EU) No 101/2011 as follows:

On 04 August 2022, the European Council amended page 162, entry number 1209 of the Official Journal of the European Union, for Alexander Anatolievich MAKSIMTSEV, in the third column headed 'Identifying information':

for: 'POB: Tokmak, Kirghiz SSR, former USSR (now Russian Federation);

read: 'POB: Tokmak, Kirghiz SSR, former USSR (now Krygyzstan).
