BackgrounD information

The European Single Electronic Format (ESEF) is the new single electronic reporting format for the preparation of annual financial reports to be published by Issuers whose securities are admitted to trading on a regulated market in the European Union for financial years beginning on or after 1 January 2021 and fall within the mandatory scope of reporting in accordance with the requirements of the ESEF Regulatory Technical Standard from 2022 onwards.
During this session the speakers, being representatives of the Malta Financial Services Authority, the Accountancy Board, the MIA ESEF Working Group (a working group under the remit of the MIA Audit and Assurance Committee) and the Malta Business Registry, will cover the main requirements for implementation of ESEF. This includes:
key information with respect to the ESEF Annual Financial Reports;
the salient points of the Accountancy Profession (European Single Electronic Format) Assurance Directive issued this year by the Accountancy Board; and
key aspects which are relevant for the auditor’s work on ESEF, including the role of the auditor.

Topics on the agendA

Initiated with the requirements mandated by the Malta Financial Services Authority (MFSA) through the Capital Markets Rules, Directive 6 - the Accountancy Profession (European Single Electronic Format) Assurance Directive - was issued by the Accountancy Board in terms of the Accountancy Profession Act (Cap. 281). This session will cover the basis of the ESEF requirements that have now entered into effect and in respect of which guidance has also been issued by MIA through a document prepared with the Accountancy Board.

SPEAKER'S PROFILE

Gabriel Aquilina is a University of Malta Master in Accountancy graduate and a Senior Analyst with the Securities and Markets Supervision function at the Malta Financial Services Authority. Gabriel works within the MFSA’s Capital Markets team and specialises in the Continuing Obligations of companies listed on a regulated market. In this respect, Gabriel supervises the issuers’ compliance with the applicable local and EU regulatory requirements. In supervision, Gabriel focuses on adherence to the Capital Markets Rules; enforcement of financial and non-financial information; and the local implementation of the ESEF Regulation, whereby he also participates in local and EU Working Groups.
Leanne Darmanin is a Master in Accountancy graduate and is currently reading for a Master of Arts in Financial Services at the University of Malta. She holds the position of an Analyst within the Securities and Markets Supervision function at the Malta Financial Services Authority. Her role within the Capital Markets team involves the supervision of companies that are listed on a regulated market in terms of the Capital Markets Rules. Leanne specialises on financial and non-financial reporting and is also involved in the implementation of ESEF in Malta.
Konrad Borg is a senior manager at PwC within the assurance line of service. He graduated from the University of Malta with a B. Accountancy (Hons) degree in 1999 and is a Fellow of the Malta Institute of Accountants. Specialising in financial reporting, auditing and assurance, his portfolio includes a number of listed and private entities in various areas of industry and commerce. His experience includes the continuing obligations of listed entities and more recently, he has also focussed on the European Single Electronic Format (ESEF), which is mandatory for all listed entities as from 1 January 2021.  He is also a seasoned trainer and lecturer through the PwC Academy, and a member of the MIA ESEF Working Group.  
Antoine Fenech is the lead Senior Manager of Assurance within the Audit and Assurance function at Deloitte providing advisory services ranging across IFRS technical advisory, accounting software implementation advisory services, internal controls assessments and training to middle and senior management. He also acts as the statutory audit senior manager on a number of local and international public interest entities. He is also a member of the MIA ESEF Working Group.  
Ivan Sammut graduated as Doctor of Laws from the University of Malta in November 1993 and obtained a Master of Arts in Financial Services from the same university in November 2001. Dr. Sammut has worked mainly in the banking and financial services industry, with his other main areas of practice being civil, administrative and commercial law. Dr. Sammut is legal consultant at the Ministry for Finance and Employment and legal adviser of the Accountancy Board. He was responsible for the transposition into Maltese law of various accounting and auditing related European Union Directives. Dr. Sammut chaired the Company Law Working Group during the Maltese Presidency of the Council of the European Union. Dr. Sammut is also a visiting lecturer at the Faculty of Economics, Management and Accounting at the University of Malta.
