&lt;h5 style="font-size: 18px;"&gt;&lt;font style="font-size: 14px;"&gt;The session will discuss the fundamental notions of Maltese competition law, with particular reference to EU law. It will provide an overview of the Maltese Competition Act and its main sources, namely Article 101 and Article 102 of the TFEU.&lt;br&gt;&lt;/font&gt;&lt;font style="font-size: 14px;"&gt;The discussion will begin by considering anticompetitive agreements as contemplated under Article 5 of the Competition Act, in particular examining what constitutes collusive behaviour between undertakings. This will be followed by an analysis of Article 9 of the Competition Act, addressing the notion of dominance, the special responsibility borne by dominant undertakings, and the abuse of such dominant positions.&lt;br&gt;&lt;/font&gt;&lt;font style="font-size: 14px;"&gt;Finally, the session will address merger control in Malta, with specific reference to the appraisal of concentrations in the Maltese scenario.&lt;/font&gt;&lt;/h5&gt;

These professionals must keep abreast on the competition law consequences which might be triggered during the business activities of the company. Examples of when these issues will arise would be in the case a company holds a dominant position in a relevant market or in the case where mergers or acquisitions with other companies are being contemplated. In the latter cases, there are certain notification obligations and the merger clearance would be required in terms of the specific competition rules.&lt;/font&gt;&lt;/h5&gt;

&lt;h5 style="font-size: 18px;"&gt;&lt;font style="font-size: 14px;"&gt;Dr Bernice Bianchi is a senior legal officer at the Office for Competition within the Malta Competition and Consumer Affairs Authority, joining the Office in 2014 after obtaining her Doctor of Laws degree (LL.D.) from the University of Malta. She is involved in overseeing investigations into suspected infringements of Maltese and EU Competition law and holds a warrant to practice before the Maltese Law Courts, representing the Office in litigation before the Maltese Courts. Bernice is also a visiting lecturer at the University of Malta, lecturing in competition law.&lt;/font&gt;&lt;/h5&gt;
